1. Agreement to Terms

By submitting a service request, you ("Customer") agree to be bound by these Terms and Conditions. These terms govern the backflow testing, inspection, and related services ("Services") provided by Apex Backflow Services ("Company," "we," "us," or "our").

2. Services

We provide backflow prevention assembly testing, inspection, repair, and reporting services as required by applicable water purveyor and regulatory requirements. Services are performed by certified backflow assembly testers (BATs) in accordance with state and local regulations.

3. Scheduling and Access

You agree to provide safe and reasonable access to the backflow assembly location at the scheduled service time. If our technician cannot access the assembly, a trip fee may apply. You are responsible for ensuring the assembly is accessible and that any gates, locks, or enclosures are open or arrangements have been made.

4. Payment

Payment is due upon completion of services unless otherwise agreed in writing. We reserve the right to charge additional fees for repairs, replacement parts, retests, or extraordinary service conditions. You will be notified of any additional charges before work is performed when reasonably possible.

5. Test Results and Reporting

We will submit test reports to the applicable water purveyor as required by law. You will receive a copy of the test report. If an assembly fails testing, you are responsible for arranging repairs and a retest within the timeframe required by your water purveyor. We are not responsible for penalties or service interruptions resulting from failure to comply with purveyor requirements.

6. Limitation of Liability

Our liability for any claim arising from Services shall not exceed the amount paid for the specific service giving rise to the claim. We are not liable for pre-existing conditions, third-party equipment failures, water damage, or consequential damages.

7. Communications

By providing your contact information, you consent to receive service-related communications including appointment reminders, test results, and invoices. You may opt out of marketing communications at any time. SMS and email opt-in preferences are governed by our separate SMS Policy and Email Policy.

8. SMS Messaging Program

Program Name: Apex Backflow Services SMS Notifications.

Description: By opting in, you agree to receive SMS text messages from Apex Backflow Services related to your service, including appointment reminders, scheduling confirmations, test results, invoice notifications, and two-way communication with our team.

Consent: By providing your mobile phone number and checking the SMS opt-in box on our service request form, you give your express written consent to receive the text messages described above. Consent to receive SMS messages is not a condition of purchasing any goods or services. Message consent is not shared with third parties for marketing purposes.

Message Frequency: Message frequency varies based on your service activity. You may receive messages related to scheduling, reminders, results, and billing.

Sample Message: "Apex Backflow Services: Your backflow test is scheduled for 6/15 at 10:00 AM. Reply HELP for help, STOP to unsubscribe. Msg & data rates may apply."

Message & Data Rates: Message and data rates may apply. These charges are billed by your mobile carrier and are your responsibility.

Opt-Out Instructions: Reply STOP at any time to unsubscribe from SMS messages. After you send STOP, you will receive one confirmation message and no further texts. Opting out of SMS messages will not affect any other services we provide to you. Reply HELP for assistance.

Privacy: No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing is limited to subcontractors and service providers (such as our messaging platform) solely to support and deliver these messages. 9. Governing Law

These Terms shall be governed by the laws of the State of Washington. Any disputes shall be resolved in the courts of applicable jurisdiction in Washington State.

10. Changes to Terms

We reserve the right to update these Terms at any time. Continued use of our Services constitutes acceptance of the updated Terms.
